Sec. 3-43. – Confinement of animals—On premises of owner.

The confining of such animal by attaching one end of a chain, rope or similar device to a collar or other device attached to the animal and attaching the other end of the chain, rope or similar device to a fixed stationary object is strictly prohibited.

If any person is found to be in violation of this section, either by the entering a plea of guilty or no contest or by final adjudication of any court, said person shall be ordered to fully comply with this section within five (5) days of the disposition of the matter. If, after five (5) days, the person fails to confine the animal or animals in violation of this ordinance, the animal control officer, or any law enforcement officer, of the city, upon the finding of probable cause by the municipal judge, shall be authorized to seize and detain said animal or animals. Such officer shall attempt to notify the person of the seizure and detention by reasonable methods and the person shall be summoned to court, within fourteen (14) days from the date of seizure of the animal or animals, to determine at a hearing, the disposition of the animal or animals and/or to face further penalties, fines, restrictions or the like.

It shall be within the authority of any court to order restitution to the city for expenses incurred for the care and housing of any animal seized pursuant to this section.
