Sec. 4-40. Cruelty to Animals.

No person shall mistreat or improperly care for or confine any animal. It shall be an offense for any animal to knowingly, willfully or maliciously:

(c) Tether an animal, as defined in Section 4-1 of this Chapter, as the sole or primary means of securing, confining or restraining such animal, whether on the Owner’s property or not. It shall be considered a violation of this Section if an animal is tethered for a period exceeding two (2) consecutive hours within any twenty-four (24) period.
