215.051: TETHERING

No dog permitted within the City of Waynesville shall be chained, tied, fastened or otherwise tethered to any stationary or inanimate object as means of confinement and restraint to the property. Exceptions to this regulation are as follows:

  1. Tethering shall be allowed on occasions when it is necessary for the dog owner or custodian to complete a temporary task that requires the dog to be physically restrained but shall not be for more than ten (10) continuous hours in a twenty-four (24) hour period.
  1. When a dog is tethered as allowed in the above exceptions, the dog must be tethered by a non-choke type collar or a body harness to a tether that is at least fifteen (15) feet long with a swivel at both ends.
  1. The tether must be free from any objects that could cause entanglement or strangulation.
  1. The dog must have access to adequate food and water at all times. Cool water in summer and unfrozen water in winter shall be provided while the dog is tethered.
  1. Proper shelter shall be provided at all times, providing protection from the snow, cold, wind, rain and sun while the dog is tethered outdoors. Adequate shelter is defined as a structurally sound, properly ventilated, sanitary, dry and weatherproof shelter suitable for the age, species and condition of the animal, which is free of litter or hazardous substances and objects, contains clean and dry bedding material and which provides access to shade from direct sunlight and regress from exposure to inclement weather conditions.
  1. The shelter must be sanitary and cleaned on a regular basis, fecal matter removed and properly disposed, so not to attract insects or rodents, become unsightly or cause objectionable odor.
  1. Any dog left unattended and/or in such circumstances which may endanger the life or health of the dog, or any dog that has been abandoned while being tethered, could be impounded by the Animal Control Officer and the release of the animal shall not be made until all expenses of apprehension, notification and impounding have been paid by the owner. Failure to claim the dog after five (5) business days shall result in the dog being offered for adoption or if determined as necessary, euthanization.
